03/16.10.2023 Learned counsel for the petitioner submits that the case is arising out of Mines and Minerals (Development & Regulation) Act 1957 alongwith Jharkhand Mines Minerals (Prevention of Illegal Mining Transportation and Storage), Rule 2017 only complaint can be maintainable whereas in the present case F.I.R. has been lodged. He submits that the case of the petitioner is covered with in the light of judgment of this Court in W.P. (Cr.) No. 361 of 2023 decided on 04.10.2023.
2. Mr. Deepankar, learned counsel for the respondent- State shall take instruction and file counter-affidavit within three weeks.
3. Let it appear on 05.12.2023.
4. Till the next date, no coercive step shall be taken against the petitioner in connection with Bundu P.S. Case No. 106/2022, pending in the Court of learned J.M., Ranchi.
