1. Heard Mr. Shailesh Kr. Singh, learned counsel appearing for
the appellant and Mr. Vineet Kr. Vashistha, leaned Additional Public
Prosecutor has sought for time to file objection to this interlocutory
application for fresh legal issues have been raised therein.
2. Mr. M.B.Lal, learned counsel has submitted that he has filed
Vakalatnama to represent the informant.
3. We on consideration of the judgment rendered by the
Hon'ble Apex Court in the case of Jagjeet Singh & Ors. versus
Ashish Mishra @ Monu & Anr, reported in (2022) 9 SCC 321 is of
the view that the informant is required to be heard.
4. Accordingly, learned counsel appearing for the appellant is
directed to serve the copy of the appeal along with the application
filed under section 389 (1) Cr. P.C. to Mr. M.B.Lal, learned counsel.
5. As prayed on behalf of the Sate and the learned counsel for
the informant, put up this case on 04.12.2023.
