1. Learned counsel for the petitioner, learned counsel for the State and learned counsel for the Union of India are present. I.A. No.7279 of 2023

2. The instant Interlocutory Application has been preferred on behalf of the petitioner to exempt from surrender before the learned Court below during the pendency of this Criminal Revision.

3. At paragraph No.14 of the instant Interlocutory Application, the ground shown that the petitioner is old aged and is having a fragile health and suffering from several illness, due to which, his health has deteriorated and is in a bad health.

4. In support of these averments, no documentary evidence has been adduced by the petitioner.

5. Learned APP appearing on behalf of the State and learned counsel appearing on behalf of the U.O.I. have vehemently opposed the contentions made by the learned counsel for the petitioner and contended that from the very judgment itself the age of the petitioner-convict is shown 45 years.

6. Accordingly, the averments made in this Interlocutory Application are found to be false in view of the age shown in the judgment itself, which is shown as 45 years old.

7. So far as the illness and bad health of the petitioner is concerned, no any documentary evidence is adduced in regard to the treatment given by any doctor and no prescription has been annexed with this I.A.

8. In view of the above, I.A. No.7279 of 2023 is hereby dismissed.

9. The petitioner is directed to surrender before the learned Court below within three weeks.

10. List this case on 10.01.2023.
