02/21.11.2023 Ms. Neha Pandey, AC to Sr. SC-III appearing on behalf

of the State respondents and Mr. Sanjoy Piprawall, learned counsel

for the respondent-JSSC, jointly raise objection with regard to the

maintainability of the writ petition primarily on the ground that the

petitioners have not made out any case as to whether in pursuance

of the judgment rendered by the Hon'ble Supreme Court in the

case of "Satyajit Kumar & Ors. Vs. State of Jharkhand &

Ors." and other analogous cases reported in 2022 SCC OnLine

SC 954, any candidate who has scored lesser marks than the

petitioners have been shown above in the state-wise merit list and

have been appointed on the post of Trained Graduate Teacher

(TGT) in different subjects.

2. It is further submitted that in fact the petitioners have

filed the present writ petition based on old district-wise merit list

prepared for appointment of candidates for the said posts

particularly prior to passing of the order by this Court in the case of

"Soni Kumari Vs. State of Jharkhand & Ors." [W.P.(S) No.

1387 of 2017] and the aforesaid judgment rendered by the

Hon'ble Supreme Court in the case of "Satyajit Kumar" (supra).

3. Learned counsel for the respondents, however, pray for three weeks' time to file respective counter affidavits.

4. Considering the said prayer, put up this case under the

heading "For Admission" on 08.01.2024.
