6/01.05.2023 Heard learned counsel for the petitioner as well as the
learned counsel for the respondent State.
2. This petition has been filed for direction upon the
respondents to take action against the private respondents as well as for
direction for proper investigation in the matter.
3. The learned counsel for the petitioner submits that police
has not investigated the matter in its right direction. Nothing has been
disclosed in the petition to suggest that how the police has not
investigated the matter in right direction.
4. This Court is not required to pass any order at each and
every stage of investigation and the investigating officer is required to
give free hand to investigate the matter unless any cogent reason is
made out to make certain direction upon the investigating officer.
5. The petitioner is having alternative remedy by way of
moving before the learned court under Cr.P.C as held by the Hon'ble
Supreme Court in the case of Sudhir Bhaskar Rao Tambey v. Hemant
Yashwant Dhage and Others, (2016) 6 SCC 277. In light of the same
judgment, no case of interference is made out.
6. Accordingly this petition is dismissed.
