th Order No.02/Dated: 4 January 2023 I.A. No. 7593 of 2022 The appellant has filed this application under section 5 of the Limitation Act seeking condonation of delay of 43 days in filing the present Letters Patent Appeal.

Mr. Sumeet Gadodia, the learned counsel has referred the following paragraphs in support of this application:

"5. That it is humbly stated and submitted that upon the receiving the information of the pronouncement of the judgment dated 06.05.2022, the department applied for certified copy of the impugned judgment and after getting the same, a decision was taken to challenge the impugned order/judgment dated 06.05.2022.

6. That it is humbly submitted that the statement of facts/grounds of appeal for filing the LPA against the impugned order/judgment has been prepared by the office of the petitioner firm and the concerned file was forwarded to the proprietor.

7. That it is humbly stated and submitted that the proprietor i.e. the present deponent was out of station/state in the month of June/July 2022 for family reasons and therefore he could not be able to contact any lawyer in Ranchi therefore this delay has occurred which is unintentional."

In view of the statements made in the interlocutory application, the delay in filing the appeal is condoned.

I.A. No. 7593 of 2022 is, accordingly, allowed. LPA No. 331 of 2022 On the request of the learned counsel for the appellant, post this

matter on 16th January 2023 under the heading 'Final Disposal'.
