06/03.01.2023 Respondent has entered appearance on notice through Vakalatnama.
Original Suit No. 34 of 2017 for dissolution of marriage with the respondent-wife under Section 13(1)(i-a) of the Hindu Marriage Act, 1955 has been dismissed by learned Principal Judge, Family Court, Hazaribag by the impugned judgment dated 21st February, 2022.
Learned counsel for the parties agree that an effort for amicable settlement of their matrimonial dispute can be made through mediation at JHALSA at this appellate stage also as the marriage is 12½ years old and no children are born out of wedlock.
Learned counsel for the appellant submits that the appellant is employed in Madhya Pradesh in Bank. Therefore, the mediation may be held at convenient date and if possible on successive dates on the first appearance. Respondent is residing at Ramgarh and she has no difficulty in attending the mediation proceeding.
In that view of the matter, let both the parties appear before the learned Member Secretary, JHALSA on 13th January, 2023 at 10.30 a.m. Learned Member Secretary, JHALSA can also be approached on the following numbers:
Cell No. 8986601912 Landline no. 0651-2482392 On their appearance, matter be placed before the learned Mediator, JHALSA for undertaking the exercise. Parties are expected to cooperate in the mediation proceedings with an open mind and attend each of the sittings.
Appellant shall pay a sum of Rs. 1000/- towards incidental and travelling expenses to the respondent on each date, she participates in the mediation proceedings, in presence of the learned Mediator, JHALSA. Since, the appellant has to come from different State, mediation can be held on successive dates at
the first instance and later date be fixed as per convenience of the parties. If the parties are able to arrive at an amicable settlement, terms and conditions thereof be reduced in writing under their joint signature and be submitted along with the report four weeks thereafter.
Matter be listed along with the report in the week of 20th February, 2023.
