Reference may be made to the order dated 30.01.2023.

The State-respondent has filed affidavit duly been sworn by the

Assistance Sub-Inspector of Police, Podaiyahatt Police Station,

District-Godda stating therein that the appellant no.3, namely,

Narayan Mistry @ Sharma has been reported to be died on

01.07.2020.

Such submission has been made on the basis of the

communication made to the learned Addl. Public Prosecutor by the

Officer-In-charge of Podaiyahatt Police Station vide communication

dated 11.02.2023 appended with death certificate issued by the

issuing authority dated 04.08.2020 as also appended with the

certificate given by the Mukhiya, namely, Pratima of Gram Panchayat

Baksra.

Since appellant no.3 has died on 01.07.2020 but there is no

application filed by the legal representatives and as such, the appeal so far as it relates to appellant no.3, stands abated.

Heard learned counsel for the parties.

Hearing is concluded and the Judgment is reserved.
