Mr. Indrajit Sinha, learned counsel appears for the appellants.

Mr. Arnab Chakraverty, learned counsel appearing for the

respondent no.3 assisted by Ms. Khushboo Kataruka, Advocate has

submitted by producing a copy of the order dated 26th March, 2019

passed by the Calcutta, High Court in C.O. No.1078 of 2019 (GPT

Infraprojects Limited vs. M/s. Miki Wire Works Private

Limited) that similar issue is now under consideration before the

Calcutta High Court, wherein the issue which is being raised on

behalf of the appellant regarding the jurisdiction of the council is

also one of the issue under consideration, as would appear from the

ground agitated on behalf of the appellant thereunder as ground

no.(ii) in which hearing concluded and judgment reserved.

He has produced the copy of the order dated 19th January, 2023.

Mr. Indrajit Sinha, learned counsel for the appellants has

submitted that he is having no instruction about pendency of such

proceeding before the Calcutta High Court, therefore, he has sought

for adjournment.

Considering, the aforesaid submission, let this matter be posted

on 23rd February, 2023.

Let a copy of orders dated 26th March, 2019 and 19th January,

2023 passed by the Calcutta High Court be kept on record.
