05/30.08.2023 Mr. Tiwary, learned counsel for the petitioner submits that the
petitioner is a minor aged about 14 years and studying in Class 9 and,
therefore, his father, who is a natural guardian, has filed the present writ
petition. He further submits that the present case has been filed
suppressing the age of the petitioner as well as the age of the complainant
in the entire case record. He submits that the entire allegations made in the
complaint is malicious in nature and the case of the petitioner is fully
covered in view of the judgment passed by the Hon'ble Supreme Court in
Arun Singh and others v. State of U.P. through its Secretary and
another; [(2020) 3 SCC 736].
2. Issue notice upon respondent no.3 by ordinary process as well as
registered post with A/D, for which, requisites etc. must be filed within a
week.
3. Let this matter appear on 18.10.2023.
4. Till the next date, no coercive steps shall be taken against the
accused, namely, Sandeep Tudu, who is being represented by his father
Samu Tudu in connection with Complaint Case No.636 of 2022, pending in
the court of the learned Judicial Magistrate, 1st Class, Dumka.
