Order No.09 Dated- 28.08.2023 It appears that in M.A. No.165 of 2019, the notice has been issued to the sole respondent but service report of the notice has not returned as yet and no Vakalatnama has been filed on behalf of the sole respondent. Although, in M.A. No.166 of 2019, the Vakalatnama has been filed on behalf of the sole respondent-Union of India represented by Captain Administrative Officer, Ranchi by Mr. Ramit Satender, Central Government Counsel and submitted that two interlocutory applications are pending for condoning of delay. Therefore, at present the appeal is not fit to be referred to National Lok Adalat scheduled to be held on 09th September, 2023.
Both learned counsels have submitted that both appeals arising out of the common judgment, hence, the appeals may be tagged with each other.
Learned counsel for the sole respondent prays for time to file counter affidavit against the interlocutory applications.
Accordingly, let these appeals be listed after six weeks.
