1. The present interlocutory application has been filed for condonation of delay of 48 days in preferring this criminal revision.

2. The reasons stated in the interlocutory application is found sufficient for condoning the delay of 48 days.

3. Accordingly, the delay of 48 days in preferring this criminal revision is, hereby, condoned.

4. I.A. No.3023 of 2023 stands allowed. Cr. Revision No.1456 of 2022

5. The present criminal appeal has been preferred against the judgment dated 5th August, 2022 passed by the learned Additional Sessions Judge-IV, Hazaribag in Cr. Appeal No.64 of 2019, whereby and whereunder the said criminal appeal was dismissed and judgment of conviction and order of sentence dated 10th May, 2019 passed by the Judicial Magistrate 1st Class, Hazaribag in Complaint Case No.1658 of 2017 has been upheld.

6. Learned counsel for the petitioner has submitted that after intervention of the well-wishers of the villagers, both parties have arrived at a compromise and the dispute has been settled. It is further submitted that the total amount of Rs.3 lacs has been received by the O.P. No.2 under the compromise which took place

out of court on 14th December, 2022 in presence of the witnesses. The compromise petition is annexed as Annexure-2 to the present criminal revision.

7. Learned counsel for the Opposite Party No.2 has conceded that the compromise has arrived at between the parties and he had received the amount of Rs. 3 lacs and the dispute has finally been settled.

8. In view of the compromise which has been arrived at between the parties, the impugned judgment of conviction passed by the learned trial court which has been affirmed by the learned appellate court is hereby set aside. The petitioner is acquitted from the charge levelled against him.

9. Accordingly, this criminal revision stands disposed of.

10. Consequently I.A. No.3186 of 2023 also stands disposed of.
