1. The instant writ petition has been instituted under Article 227 of Constitution of India assailing the order passed by learned Sub-Judge, Koderma in Title Suit No.34 of 2010 dated 30.08.2016, whereby and whereunder the writ petition under order 6 Rule 17 of CPC read with Section 151 of CPC filed by the petitioners/plaintiffs has been rejected.

2. On call none appeared on behalf of the learned counsel for the petitioners whereas Mr. Bhaiya Vishwajeet Kumar, learned counsel for the respondents has appeared and informed this Court that the said title suit has been disposed off and decreed vide judgment dated 06.06.2023., Hence, this writ petition has become infructuous.

3. Considering the aforesaid facts and none appearance of learned counsel for petitioners also for prosecuting the case, this writ petition is dismissed as infructuous.

4. Accordingly, the interlocutory application i.e., I.A. No.8528 of 2016 is also disposed off.
