03/11.10.2022. Learned counsel for the petitioner submits that cheque has been

issued by the partnership firm namely New Saree Sangam. He further

submits that liability cannot be fastened upon the petitioner in view of

Section 141 of N.I. Act. He also submits that this case is fully covered in

view of the judgment passed by the Hon'ble Supreme Court in Dilip

Hairamani V. Bank of Baroda; [2022 0 Supreme (SC) 417] .

Let notice be issued upon opposite party no.2 under registered cover

with A/D as well as ordinary process for which requisites etc. must be filed

within two weeks.

There shall be stay of further proceeding in connection with

Complaint Case No. 178 of 2018, pending in the Court of learned A.C.J.M.,

Bokaro, till the next date.

Let this matter appear on 06.02.2023.
