Mr. Haider Ali, the learned counsel for the petitioners has appeared today and informed the Court that with the help of the well-wishers in the society the wife has joined the company of her husband in her matrimonial home since July, 2017.

The petitioner no.1 is the son of the petitioner no.2. During pendency of the present criminal revision petition, the petitioner no.2 has passed away and, therefore, the present criminal revision petition qua petitioner no.2 Prakash Thakur is dismissed as not pressed.

By an order dated 2nd May 2022, Mr. Randhir Kumar, the learned counsel was appointed as Amicus as the petitioners failed to appear in the present proceeding.

The learned Amicus submits that the offence under section 498A of the Indian Penal Code is not compoundable, however, under certain circumstances after upholding the judgment of conviction the order of sentence can be set-aside by the High Courts.

Mr. Shahid Yunus, the learned counsel appears for O.P No.2 and states that now O.P No.2 who joined the company of her husband has no grievance against her husband and she is residing in her matrimonial home happily.

The learned Amicus and the learned counsels appearing for the parties shall produce judgments on the issue.

The learned Amicus shall be paid Rs.5500/- for each date of hearing.

The fee for the learned Amicus shall be paid by the Department of Home, Government of Jharkhand.

Post the matter on 24th June 2022.
