1. The present revision application has been filed against the judgment dated 26.06.2019, passed under Section 125 of the Cr.P.C by the court of learned Principal Judge, Family Court, Deoghar in Cri. Misc. Case No.62 of 2017, whereby the maintenance amount of Rs.5,000/- (Five thousand) per month in favour of the wife/ O.P. No.02 has been awarded .

2. The other factors are not in dispute save and except the quantum of maintenance. It has been submitted by the learned counsel for the revisionist that the maintenance has been decided on the basis of the fact that the revisionist is employee of the Railway. Now the revisionist has been dismissed from service. On above facts, prayer has been made that liberty should be given to the revisionist to approach the court below under Section 127 of the Cr.P.C.

3. Learned A.P.P is present.

4. In view of the above submission of the learned counsel for the revisionist, the present criminal revision application stands disposed of giving liberty to the revisionist to approach the court below under Section 127 of the Cr.P.C, bringing on record his income, if any and the other relevant facts. If any such petition is filed in the court below, the court below is directed to decide the same on its own merit without being prejudiced by the order of this Court.

5. I.A. No.4846 of 2021 stands disposed of.
