1. The present revision application has been filed against the judgment dated 30.07.2019, passed under Section 125 of the Cr.P.C by the court of learned Principal Judge, Family Court, Koderma in Original maintenance Case No.32 of 2019, whereby the maintenance amount of Rs.7,000/- (Seven thousand) per month in favour of the wife/ O.P. No.02 has been awarded.
2. It has been stated by the learned counsel for the revisionist that the alleged Nikah is by force and as such the same is nullity and the wife is not entitled for the maintenance. It has been further submitted that thereafter further development has taken place between the parties and the matter has been settled outside the Court. Learned counsel for the revisionist seeks liberty to approach the court below under Section 127 of the Cr.P.C for the settlement of the dispute taking the plea of subsequent development.
3. In view of the above submission of the learned counsel for the revisionist, the present criminal revision application stands disposed of with the liberty aforesaid. If any such petition is filed in the court below, the court below shall decide the same on its own merit without being prejudiced by the order of this Court.
