Order No. 03: Dated: 21st December, 2022 Learned counsel for the parties is present. It has been pointed out by the office that this appeal is not maintainable in view of the fact that the judgment of acquittal has been passed by the Additional Chief Judicial Magistrate, Chatra under which the respondent nos. 2, 3, 4 and 5 have been acquitted after the trial in connection with Itkhori P.S. Case No. 47 of 2017 registered (corresponding to G.R. Case No. 857 of 2017) for the offence punishable u/s 341, 323, 324, 504, 354/34 of IPC.
Learned counsel appearing for the appellant seeks permission to withdraw this appeal, in view of the report of office, with a liberty to take appropriate course of action as per the provision of law.
Accordingly, this appeal is disposed of as withdrawn.
