07 / 01.12.2022 Instant appeal was preferred by the aggrieved husband against the dismissal of Original Suit No. 314/2019 instituted under section 9 of Hindu Marriage Act, 1955 for restitution of conjugal rights with the Respondent/wife, vide impugned judgment dated 27.02.2020 passed by the learned Principal Judge, Family Court, Dhanbad.

2. Learned counsel for the appellant however seeks permission to withdraw this appeal on instruction. Learned counsel for the Respondent does not object.

3. In view of the prayer made, instant appeal is dismissed as withdrawn. Let lower courts records be sent down to the court concerned.
