03/Dated: 31/08/2022 Learned counsel for the petitioner submits that accused no. 3-

Sandeep Banerjee and O.P. No. 2 are related to each other. He submits that

family arrangement has been made in which the land in question is in the

share of accused no.3 to which the accused no. 3 sold the land to the

accused no. 1. He further submits that on false claim that share of the

complainant has been sold by the accused no. 3 in connivance with

petitioner, the present case has been filed by the O.P. No. 2. He submits that

the case of the petitioner is fully covered with judgment in the case of "

Md. Irbahim & Ors. V. State of Bihar and Anr. reported in (2009) 8

SCC 751.

Let notice be issued upon O.P. N. 2 under registered cover with

A/D as well as by ordinary process for which requisites etc. must be filed

within two weeks.

No coercive step shall be taken against the petitioner in

connection with Dhalbhumgarh P.S. Case No. 41/2022 arising out of

Complaint Case No. 190 of 2022 pending in the Court of learned S.D.J.M.,

Ghatsila till the next date.

Let this matter appear on 19.12.2022 along with Cr.M.P. No.2522

of 2022.
