9/22.08.2022 Counsel for the appellant submits that the issue relates to violation of terms and condition of policy, which has not been dealt with properly by the Tribunal. He relies upon the judgment of the Hon'ble Supreme Court in the case of Pappu & Ors. Vrs. Vinod Kumar Lamba & Anr. reported in (2018) 3 SCC 208.
Considering the aforesaid submission, this appeal will be heard. Admit.
Issue notice upon respondent no.2 by both process, for which requisites etc, under registered process as well as through ordinary process must be filed within two weeks.
It is not necessary to issue notice to respondent no.1 as he has already appeared. Since respondent no.3 is driver of the vehicle and no relief has been claimed against the driver of the vehicle thus there is no need to issue notice to respondent no.3.
