Learned counsel for the petitioner, Mr. Prashant Kumar Shrivastava seeks permission to withdraw this writ petition as inadvertently the writ petition has been filed for direction upon the respondents for non- compliance of the judgment dated 28.10.2010 and decree dated 03.11.2010 passed by learned Sub-Judge-IV, Hazaribag in Title Suit No.47/2009.

Learned counsel for the respondents/ State, Ms. Bandana Sinha, A.C. to Mr. P.A.S. Pati, G. A.-II has submitted that the execution case ought to have been filed by the petitioner instead of preferring writ petition before this Court.

Considering the same, the instant writ petition is dismissed as withdrawn.
