Learned counsel for the petitioner, Mr. S.N. Das seeks permission to withdraw this application, so as to seek liberty of this Court to raise all these issues before the first appellate court, where the appeal is pending, preferred by the judgment debtor against the decree passed by the learned trial court.

Learned counsel for the respondent no. 2, Mr. Mahavir Prasad Sinha has no objection.

Considering the same, the present writ petition is dismissed as withdrawn with liberty to the petitioner to raise all the points before the learned appellate court.
