02/22.09.2021. Heard Mr. Jitesh Kumar, learned counsel for the petitioner and

Mr. Ashok Kumar, learned A.P.P. for the opposite party-State.

This criminal miscellaneous petition has been taken through Video

Conferencing in view of the guidelines of the High Court taking into account

the situation arising due to COVID-19 pandemic. None of the parties have

complained about any technical snag of audio-video and with their consent

this matter has been heard.

After some arguments, Mr. Jitesh Kumar, learned counsel for the

petitioner seeks permission to withdraw this petition for taking appropriate

steps in light of the Full Bench judgment passed by this Court reported in

2018 (4) JLJR 245.

Accordingly, this criminal miscellaneous petition stands dismissed as

withdrawn.

If the limitation arises, the pendency of this petition shall be taken

into account for deciding limitation.
