Heard learned counsel for the parties.

Mr. Mukesh Kumar Sinha, learned counsel for the petitioner after

arguing the matter on fact has relied upon a judgment passed by Division

Bench of this Court in L.P.A. No.623 of 2018 disposed of on 07.04.2020.

He submits by putting reliance on the said judgment that the factual

aspects of this case is similar and therefore, the said judgment is applicable

to this case.

Learned counsel for the respondent-BCCL has sought for two weeks'

time to go through the said judgment and address the Court further on the

issue.

Accordingly, as prayed for, list this case one week after Deepawali

Holiday on 25.11.2021.
