3/28.10.2021 Learned counsel Mr. Arvind Kumar Choudhary is appearing on behalf of the appellants.

2. Learned counsel Mr. Sanat Kumar Jha is appearing on behalf of the State.

3. Learned counsel for the appellants submitted that the appellant Ganesh Singh was convicted for the offences punishable under Sections 324, 341, 323/34 of the IPC and appellants No.2 & 3 were convicted for the offences under Sections 323, 341/34 of the IPC.

4. Further the learned Trial Court below had directed the appellants to get the benefit of Probation of Offenders Act after furnishing a bond of Rs.10,000/- with two sureties of the like amount each to maintain peace and good behavior for the period of three years vide judgment of conviction and order of sentence dated 13.10.2003 in this case. Further, it has been submitted that now the period of bond for maintaining peace and good behavior is over and thus the direction under the Probation and Offenders Act has become infructuous and it is also submitted that now the parties do not want to continue with this case and therefore let this case be disposed of accordingly.

5. Learned APP appearing on behalf of the State does not have any objection.

6. Accordingly, let this case be disposed of in terms of submission advanced by learned counsel for the appellants Mr. Arvind Kumar Choudhary that the period of bond to maintain peace and good behavior for the period of three years is already exhausted and this appeal has become infructuous to that effect.
