Heard learned counsel for the appellant and learned A.P.P. on the prayer for condonation of delay of 492 days in preferring the appeal, made through I.A. No. 4197 of 2021.

Learned counsel for the appellant submits that appellant being poor could not prefer the appeal in time and therefore approached the Jharkhand High Court Legal Services Committee for legal aid. Thereafter the papers were obtained and the appeal has been filed, which has occasioned some delay, though it is not deliberate. Appellant would suffer irreparably, if the delay is not condoned.

Learned A.P.P. does not oppose the prayer.

Having considered the submissions of the parties and the grounds urged, delay is condoned. I.A. No. 4197 of 2021 stands disposed of.

The sole appellant stands convicted for the offence punishable under Section 376(2) of the I.P.C by the impugned judgment dated 07.12.2018 passed in Sessions Trial No. 176 of 2014 by the court of learned Additional Sessions Judge- II, Special Fast Track Court (Crime Against Women), Bermo at Tenughat and has been sentenced to undergo R.I. for 11 years with a fine of Rs.4000/- and a default sentence by the impugned order of sentence dated 11.12.2018.

Admit.

Call for the Lower Court Record in connection with Sessions Trial No. 176 of 2014 from the court of learned Additional Sessions Judge-II, Special Fast Track Court ( Crime Against Women), Bermo at Tenughat.
