The present interlocutory application has been filed on behalf of the petitioner for suspension of sentence, during pendency of the instant criminal revision petition.

The instant criminal revision has been filed against the judgment dated 02.12.2019 passed in Criminal Appeal No.21/2017 by the court of learned Additional Sessions Judge-1st, Lohardaga, who has affirmed the order of sentence and conviction dated 08.03.2017 passed by the learned Sub Divisional Judicial Magistrate, Lohardaga in Complaint Case No.247 of 2016 (T.R. No.331/2017), for the offence under Section 138 of the N.I. Act and the petitioner has been sentenced to undergo S.I. for one year and has been directed to pay Rs.6,00,000/- as compensation.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 23.04.2021 and had served more than half of the sentence as imposed by the trial court.

In view of above submission and in the attending facts and circumstances of the case, I am inclined to enlarge the petitioner on provisional bail for a period of three months, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Lohardaga in Complaint Case No.247 of 2016 (T.R. No.331/2017).

Office is directed to list this case after three months.
