04 / 07.10.2021 The sole appellant stands convicted for the offence punishable under sections 304B/34 and 315/34 of the Indian Penal Code by the impugned judgment dated 30.06.2020 passed in Sessions Trial No. 07/2015 by the Court of learned Additional Sessions Judge-VII, Palamau and has been sentenced to undergo R.I for life with a fine of Rs. 25,000/- and default sentence under section 304B/34 of the Indian Penal Code and further sentenced to undergo R.I for ten years with a fine of Rs. 10,000/- and default sentence under section 315/34 of the Indian Penal Code by the impugned order of sentence dated 06.07.2020.

3. Call for the lower court records in connection with Sessions Trial No. 07/2015 from the Court of learned Additional Sessions Judge-VII, Palamau.

4. It appears from perusal of the impugned judgment that co-accused Bipin Singh was shown as absconder at the time of filing of charge sheet vide charge sheet no. 197/2014 dated 13.11.2014. It further appears that the records of the said co-accused was separated from the instant Sessions Trial. Learned A.P.P would inquire whether co- accused Bipin Singh has been apprehended or not and what is the status of trial. Let an affidavit be filed within a period of four weeks.
