2. The instant petition has been preferred by the

petitioner for modification in the order dated 03.09.2020

passed in W.P.(S) No. 4708 of 2009 only to the extent that

on the issue of termination, the petitioner should be

granted liberty to approach the appropriate authority for

redressal of his grievance and also for observing in the

order; the time limit in which the payment of his salary

should be made in view of para 11 of the judgment.

3. Learned counsel for the respondent-State does not

have any objection.

4. In view of the aforesaid submission and looking to

the averments made in this Civil Miscellaneous petition, it

appears hat there won't be any change in the nature of the

order, if aforesaid prayer of the petitioner is allowed.

5. In this view of the matter, the instant Civil

Miscellaneous petition, is, hereby, allowed by adding the

following paragraph as 11-A.

"11-A. The petitioner would be at liberty to approach the concerned respondent for redressal of his grievance with regard to his termination and since the matter is very old; as such, the petitioner shall be paid the salary as directed in paragraph 11 hereinabove, within a period of 16 weeks from the date of receipt/production of copy of this order."

6. With the aforesaid modification in the order dated

03.09.2020 passed in W.P.(S) No. 4708 of 2009, the instant

Civil Miscellaneous petition stands allowed.
