04/20.11.2021:         Petitioner claims that order dated 16.08.2018 has been violated, thus prays

to initiate contempt proceeding against the respondent.

After going through the order dated 16.08.2018 passed in W.P. (C) No. 5754 of 2017, I find that in the aforesaid writ application petitioner has prayed to quash the order dated 14.03.2016 (annexure 9 to that writ application) by which the petitioner was black listed. Further a prayer was made to pay the admitted dues.

After considering the Judgment of the Hon'ble Supreme Court, the order of black listing the petitioner was quashed and set aside. So far as the admitted dues is concerned, a liberty was given to the petitioner to raise their grievances before the appropriate authority.

From the petition, I find that there is nothing on record that the order by which the black listing of the petitioner has been set aside has not been given effect to by the State. Further the petitioner has already raised his grievance and has claimed the admitted dues. In the order passed by this Court in W.P. (C) No. 5754 of 2017 there was no direction given to pay any amount to the petitioner.

Thus, in view of the nature of the order passed by this Court and the relief which has been granted to the petitioner, I find that no contempt at this stage is made out. This contempt proceeding is thus dropped.
