This criminal revision has been filed by the husband/petitioner against the judgment dated 13.02.2017 passed by learned Principal Judge, Family Court, Koderma in Maintenance Case No.50 of 2015 by which application filed by Opp. Party has been allowed and directed the petitioner to give Rs.3,000/- to the wife per month, as maintenance.
Except quantum of maintenance, other factors are not in dispute. Allegation against the petitioner is that he has assaulted the wife and demanded dowry and as such, she does not want to live with the petitioner. Plea of divorce has been taken by husband.
Law is clear that even divorced wife is entitled for maintenance. The court below has occasion to interact with the parties and after assessing their status and other factors, quantum of maintenance has been decided.
In view of the above discussion, I find no reason to interfere with the impugned judgment. Accordingly, it is hereby, dismissed.
In view of the dismissal of present criminal revision, pending I.A. for condonation of delay is disposed of.
