The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.

06/ 25.03.2021 Heard learned counsel for the appellant No. 3 Sonu Gope and learned counsel for the State, on the interlocutory application, filed on behalf of appellant No. 3, for granting bail, during the pendency of this appeal.

The appellant No. 3, along with the other co-accused persons, has been convicted and sentenced for the offences under sections 302 / 34 and 120-B of the Indian Penal Code. From the impugned Judgment it appears that there is no eye witness to the occurrence of assault to the deceased and the appellant No. 3, was on bail during trial. In the similar circumstance the other co-accused persons have been granted bail.

In the facts of the case, we are inclined to release the appellant No. 3 Sonu Gope, on bail. Accordingly, the appellant No. 3, named above, is directed to be released on bail, during the pendency of this appeal, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IV, Jamshedpur, in connection with S.T. No. 268 of 2015.

The aforesaid interlocutory application stands allowed.
