1. The revision is directed against the judgment dated 20.01.2020 passed by the court of learned Additional Sessions Judge-III, Deoghar in Cr. Appeal No.38 of 2019 affirming the judgment dated 18.02.2019 passed by the court of learned Judicial Magistrate, 1st class, Deoghar in G.R. Case No.967 of 2017 whereby the petitioner was found guilty and convicted for the offence under Section 25(1-b)(a) and Section 26 read with Section 35 of the Arms Act and sentenced to undergo simple imprisonment of three years and to pay a fine of Rs.5,00/- in default thereof to suffer simple imprisonment of one month.

2. Heard learned counsel for the petitioner and learned APP, on the prayer for suspension of sentence and grant of ad-interim bail to the petitioner. On perusal of the record it appears that the petitioner was in custody since 08.06.2017 to 10.05.2019 during trial and is in custody since 27.07.2020 till date.

Taking into account that the petitioner has remained in custody for more than half of the period of imposed sentence, he is directed to be released on bail on suspension of sentence on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Deoghar in G.R. Case No.967 of 2017, with the condition that the petitioner shall deposit the fine amount of Rs.5,00/- in the court below.
