Ms. Ruby Pandey, the learned counsel appears for the
State.
This criminal miscellaneous petition has been heard through
Video Conferencing in view of the guidelines of the High Court taking into
account the situation arising due to COVID-19 pandemic. None of the
parties have complained about any technical snag of audio-video and
with their consent this matter has been heard.
Status report has been received whereby it has been
informed that the case was disposed of by the judgment dated
19.08.2015 whereby the court of learned Judicial Magistrate, First Class
acquitting the accused u/s 323/420 of IPC and convicting the accused u/s
406 IPC against which the appeal preferred before the learned Additional
Judicial Commissioner-XIII has dismissed the appeal in Criminal Appeal
No.172/2015. The cognizance order which is under challenge in this
criminal miscellaneous petition has become infructuous.
Cr.M.P. No.1362 of 2013 is dismissed as infructuous.
