2. Heard Mr. Shekhar Sinha, learned P.P. Appearing for the opposite

party-State.

3. This criminal miscellaneous petition has been heard through Video

Conferencing in view of the guidelines of the High Court taking into account

the situation arising due to COVID-19 pandemic. The party has not

complained about any technical snag of audio-video and with his consent

this matter has been heard.

4. Status report has been received, whereby, it has been informed that

the trial of the petitioner vide S.C. No. 33(B)/2010 (Split-up record of S.C

33/2010) has been kept pending in the Court of Additional Sessions

Judge-I, Sahibganj awaiting the order of this Court in the present petition.

The original case record of S.C. no.33/2010 has been disposed of by the

Court of Additional Sessions Judge (F.T.C.), Sahibganj vide judgment

dated 29.01.2011, whereby, accused persons, namely, Azad Ansari,

Sajjad Ansari, Tohid Ansari, Manoj Paswan and Sonu Paswan have been

acquitted.

5. In view of the status report and considering the fact that nobody is

appearing on behalf of the petitioner on repeated calls, this criminal

miscellaneous petition stands dismissed.

6. Interim order dated 13.03.2013 stands vacated.
