6/18.06.2021 Heard Mr. Anoop Kumar Mehta, the learned counsel for the petitioner and Mrs. Nehala Sharmin, the learned State counsel.

This criminal miscellaneous petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

I.A. No.2549 of 2021 has been filed for extending the stay order dated 24.11.2017 passed by this Court in Koderma P.S.Case No.169/2015 corresponding to GR No.1018/2015 pending in the court of learned Chief Judicial Magistrate, Koderma.

Mr. Mehta, the learned counsel for the petitioner submits that in view of the judgment of Hon'ble Supreme Court in "Asian Resurfacing of Road Agency v. Central Bureau of Investigation" reported in (2016) 1 SCC 299, the trial court has now further proceeded. He submits that the Cr.M.P is pending before this Court and it is desirable that the interim order passed earlier may kindly be extended till the final disposal of this Cr.M.P.

Mrs. Nehala Sharmin, the learned counsel appearing on behalf of the respondent State opposed the prayer of Mr. Mehta, the learned counsel for the petitioner and submits that the trial court has rightly proceeded in view of Hon'ble Supreme Court judgment.

On earlier occasion the stay was thrice extended and considering that this Cr.M.P is pending before this Court, the interim order is extended till the next date.

I.A. stands allowed and disposed of.

Post the matter on 09.09.2021.

Let name of Mrs. Nehala Sharmin, the learned counsel be reflected in the cause list on behalf of respondent State.
