06/26.07.2021:           The petitioner has superannuated from the post of Assistant Teacher.

In this petition, the petitioner has prayed for direction upon the respondent authorities for payment of pension and entire retiral dues.

Counsel for the petitioner submits that during the pendnecy of the writ petition, all retiral dues have been paid to the petitioner after the delay of 18 months. He submits that the petitioner to entitled to receive interest on the amount of delayed payment.

In view of the aforesaid fact and the fact that all retiral dues have been paid to the petitioner, without entering into merit of this case, I direct the petitioner to file representation before respondent No. 2 claiming interest on the amount of delayed payment within eight weeks from today. On receipt of such representation, respondent No. 2 will consider the claim of the petitioner as to whether he is entitled to receive any amount or not. If it is found that the petitioner is entitled to receive interest on the amount of delayed payment, the same should be disbursed to him within a period of six weeks thereafter.

It is expected that respondent NO. 2 will consider the case of the petitioner in terms of the judgment of the Hon'ble Supreme Court of India passed in the case of Vijay L. Mehrotra-Versus- State of U.P. and Others reported in (2001) 9 SCC 687 as well as judgment of this Court passed in WP(S) No. 4029 of 2016.

With the aforesaid observation and direction, this petition stands disposed of.
