03/05.07.2021 After some argument, learned Senior Counsel for the appellant, Mr. B.M.Tripathy does not want to press the I.A.No. 2601 of 2021 seeking suspension of sentence made on behalf of this appellant, at this stage. Mr. Saket Kumar, learned A.P.P does not object to the prayer.
In view of the prayer made, the instant I.A is dismissed as not pressed.
It appears from perusal of the impugned judgment especially in paragraph no. 3 that while submitting charge-sheet for the offence under Sections 304(B)/34 of I.P.C against the two persons the appellant and his mother, Purni Devi investigation was kept pending against the remaining accused persons. Learned A.P.P. would ascertain as to the status of the investigation, whether any charge-sheet has been filed, if so, what is the stage of the trial. Let the affidavit be filed to that effect.
Let the name of Mr. Saket Kumar appear as learned A.P.P in the cause list henceforth in place of the erstwhile learned A.P.P., Mr. Vinay Kumar Tiwary.
