05/01.07.2021 The order of recovery is under challenge. The petitioner a grade III

employee working as an Assistant has thrown challenge to arbitrary and illegal

order issued by the respondent regarding recovery of the amount of Rs.

4,04,854/-.

Learned Counsel for the petitioner places heavy reliance on the

judgment of the Hon'ble Apex Court rendered in the case of "State of Punjab

& Ors. Vrs. Rafiq Masih (White Washer) & Ors.", reported in (2015) 4 SCC

334.

However, learned Counsel for the State Mr. Rahul Saboo

vehemently opposing the contention of the learned Counsel for the petitioner

places heavy reliance on the judgment rendered in the case of "High Court of

Punjab and Haryana & Ors. Vrs. Jagdev Singh", reported in (2016) 14 SCC

267 and justifies the impugned order.
