Order No.11/Dated: 01st July, 2021 In course of the argument, a controversy arose whether charges for the substantive offences were framed with the aid of section 34 of the Indian Penal Code and whether a separate charge under section 376(2)(g) of the Indian Penal Code was framed against the accused or not.

The learned counsels appearing for the parties have inspected the records and reverted to us after the recess.

We are informed that charges were framed with the aid of section 34 of the Indian Penal Code and a separate charge for gang rape was also added in the midst of the trial.

In the aforesaid changed scenario, Mr. Monazir Niyazi, the learned counsel for the appellants states that some parts of the written submission filed by him were therefore not correct and he has now filed a modified written submission.
