This crimimal appeal was ordered to be listed along with Acquittal Appeal No. 23 of 2004 and Cr Revision No, 374 of 2004, vide order dated 27.07 2011,

These matters were listed before us on 11.01.2021, 19.01.2001, 20.01.2027 and 21,01 2021.

On 2LOL2021, Mr. Sanjay Kumar Srivastava, the learned APP informed the Court about death of three of the respondents In Acquittal Appeal No.23 of 2004 and, accordingly, hearing of these matters was adjourned for today. |

After briefly hearing, we find that hearing of Cr. Appeal (DB) No, 236 of 2011 cannot cantinue along with Acquittal Appeal No, 23 of 2004 with Cr Revision No. 374 of 2004. These matters arise out of Bandgaon (Keraikelia} PS case No. 34 af 2002 which was lodged on 27.97.2002. However, case records af Passing Gagrai was split up and he has faced the trial separately vide Sessions Trial No. 16 of 2008. In both the sessions trials eviderices of the prosecution witnesses were taken separately and two separate judemenis were delivered, In Sessions Trial No. 16 of 2003 which WHS Conducted against eleven accused persons, they were acquitted by the Sessions Court.
