2. The instant writ application has been preferred by the petitioner praying for quashing and setting aside the order dated 31st October, 2007 passed by Respondent No.3 to the extent that petitioner will be given promotion from 20.8.1994 in view of the order of the Hon'ble Supreme Court of India.
The petitioner has further prayed for grant of A.C.P. to which he is entitled after completion of 12/24 years of service.
3. Learned counsel for the petitioner submits that the issue involved in this case has already been decided in S.L.P. (Civil) No. 12013 of 1998, as such he submits that the petitioner may be given liberty to approach the concerned respondents who shall decide the claim of the petitioner in the light of the aforesaid judgment.
4. Mr. S. P. Rai, learned counsel for the State submits that the issue was reconsidered and the same has been decided by a Division Bench of this Court in W.P.(S) No. 4272 of 2006 (Humayun Azam Vrs. The State of Jharkhand) on 09.8.2007; as such, the petitioner may be granted liberty to approach the concerned respondent who shall pass the order in the light of judgment passed in W.P.(S) No. 4272 of 2006.
5. In view of the limited submission of learned counsel for the parties, the instant writ application, is hereby, disposed of by giving liberty to the petitioner to approach the concerned respondent raising his claim along with supportive documents and judgments cited herein above.
If any such representation is filed before the concerned respondent; the same shall be disposed of in accordance with law and in the light of judgments referred to herein above and the order shall be communicated to the petitioner.
7. With the aforesaid observation and direction, the instant writ application stands disposed of.
