The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.

03/18.02.2021 Heard learned counsel for the petitioner and learned counsel for the State.

The present application has been filed for grant of regular bail to the petitioner in connection with Sadar P.S. Case No.133 of 2007, corresponding to G.R. Case No.456A of 2007, registered under Sections 364/ 365/ 302/ 120(B)/ 201/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 10.08.2020. It has been further submitted that the petitioner was out of station for livelihood and as such he was not aware regarding the present case. During lockdown, when he came back, he has been arrested in the present case. It has been further submitted that the co-accused has faced the trial in S.T. No.255 of 2007. They have been acquitted vide judgment dated 04.11.2014. It has been further submitted that there is no material against this petitioner and as such he may be enlarged on bail.

On the other hand, learned A.P.P. has opposed the prayer for bail. Considering the material available on record, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Palamau at Daltonganj in connection with Sadar P.S. Case No.133 of 2007, corresponding to G.R. Case No.456A of 2007 subject to the conditions that the petitioner will submit self attested copy of his Aadhar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
