2. The grievance of the petitioner is that though he belongs

to the State of Jharkhand and he is under reserved category but

his case for promotion has not been considered in spite of the

specific finding given by the Division Bench of this Court in

W.P.(S) No. 578 of 2004 (Kavita Kumari Kandhw & Ors vs. The

State of Jharkhand & Ors.). In para 16 of the judgment, the

Division Bench has held that the persons are not entitled to

claim appointment against the reserved post in the State of

Jharkhand, if they produced caste certificate issued by the

District of State of Bihar, however the case of this petitioner has

not been considered for promotion and the respondents came

with the notification in the year 2008 whereby they have taken

the decision that all persons who are having caste certificate of

State of Bihar shall get benefit of reservation in the State of

Jharkhand also.

3. Learned counsel for the respondent is directed to give

specific reply to the aforesaid contention of the petitioner and

also paragraph 37 of the writ application on and before the next

date of hearing.
