03/09.02.2021 Call for an explanation from the Judicial Magistrate-1stClass, Dhanbad stating as to why inspite of order passed in the case of Md. Rustum @ Rustam & Ors Vrs. State of Jharkhand in Cr.M.P No. 2722 of 2019 which has been circulated as per the direction given in the case of Arshad Ayub Vrs. State of Jharkhand passed in Cr.M.P No. 609 of 2020 to each of the court below, process under Section 82 Cr.P.C has been issued in a most mechanical manner.

This order has been passed in utter ignorance of the judgment passed by this Court in the case of Md. Rustum @ Rustam & Ors Vrs. State of Jharkhand passed in Cr.M.P No. 2722 of 2019.

Principal District Judge, Dhanbad is directed to forward a copy of Form-IV issued pursuant to the impugned order dated 22.12.2020 passed in Sudamdih P.S. Case No. 91 of 2020.

List this case after three weeks awaiting reply under the heading 'For Orders'.

In the meantime no coercive steps shall be taken against the petitioner in connection with Sudamdih P.S. Case No. 91 of 2020, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad.
