From the report of Principal District Judge, Saraikella- Kharsawan it appears that Compensation Case No.13/2006 filed under Section 166 of the M.V. Act by the claimants- Vidyawati Devi and Another has been disposed of on the basis of compromise between the parties vide judgment dated 04.02.2011 in which the Insurance Company was directed to pay the amount by furnishing account payee cheques in the name of claimants Vidyawati Devi and Sambhu Nath Prasad for Rs.1,10,000/- and in the name of O.P. No.4 - Pushpalata Srivastav for Rs.1,40,000/- and the said amount have been received by the claimants.

In view of disposal of original claim case filed under Section 166 of the M.V. Act has been disposed of, the appeal filed by Pushpalata Srivastav for getting the share in the award under Section 140 of M.V. Act is substantially satisfied, accordingly the appeal has become infructuous with the interlocutory order merging with the final award.

Under the circumstance, the appeal stands dismissed.
