2. The instant writ application has been preferred by

the petitioner praying for a direction upon the respondent-

Authorities to allow the petitioner to discharge his duty on

the post on which he was discharging his duty in

pursuance of appointment letter issued by the Deputy

Director Health Services, Patna.

3. At the outset, learned counsel for the respondent-

State referred a judgment of the Hon'ble Apex Court in the

case of State of Bihar and Others Versus Devendra

Sharma reported in (2020) 15 SCC 446 and submits that

the issuance of appointment letter by Dr. A.A.Mallick has

been discarded by the Supreme Court and finally it has

been set at rest and in view of the judgment wherein at

paragraphs 9, 11, 34, 44 and 45, no relief can be granted to

this petitioner.

4. Mr. Rajnikant Ojha, learned counsel for the

petitioner vehemently argued that the action of the

respondent is not in accordance with law; however he failed

to dispute the fact that Supreme Court has already decided

this issue recently.

5. Having heard learned counsel for the parties and

after going through the judgment passed by Hon'ble Apex

Court in the above referred case, no relief can be granted to

this petitioner.

6. Consequently, the instant writ application stands

dismissed.
