The instant Second Appeal has been preferred against the concurrent findings of both the courts below i.e. against the judgment dated 30.07.2016 and decree signed on dated 12.08.2016 passed by learned District Judge-II, Koderma in Title Appeal No.26 of 2008, whereby the judgment dated 06.05.2008 and decree signed on dated 14.05.2008 passed by learned Munsif, Koderma in Title Suit No.42 of 2003 has been affirmed.

It appears that defect nos.1 as pointed out vide further Stamp Reporting dated 08.10.2018 has not been removed.

Defect No. 1 is as follows:-

Defect no.- Since this memo of appeal is based on some facts. Hence affidavit may be filed and the memo may be addressed to Hon'ble the Chief Justice.

Learned counsel for the appellant has prayed for two weeks time to remove the defect.

Considering the same, two weeks' time is granted to remove the defect, failing which, this appeal shall stand dismissed without further reference to the Bench, as the appeal is of the year, 2016.
