The matter has been heard through video conferencing.
Mr. Nitin Kumar Pasari, learned counsel for the petitioner has argued out his case.
Mr. Sreenu Garapati, learned SC-III representing the State of Jharkhand, Mr. Krishna Murari, learned counsel appearing for the Jharkhand Education Project Council and Mr. Rajeev Sinha, learned Assistant Solicitor General of India have also placed the case.
In course of argument, it has been submitted that one matter pertains to National Printer Proprietor Apex Products Private Limited in which the Division Bench of this Court has passed an order in L.P.A. Nos.600 of 2017 and 03 of 2019 upon which the learned counsel for the petitioner has given much emphasis by making a submission that this case is squarely covered with that judgment, therefore, he is also entitled to get the same relief, save and except, the part of the share which the Central Government is to disburse as per the terms of the contract.
It has been submitted by the learned counsel for the respondents jointly that the order passed in L.P.A. Nos.600 of 2017 and 03 of 2019 has travelled up to the Hon'ble Supreme Court in S.L.P. No.13651 of 2019 whereby and whereunder an order has been passed on 05.07.2019 requesting the High Court to make an early adjudication of the dispute between the Central Government and the State Government regarding the release of the SSA fund, therefore, submission has been made that since the matter pertaining to National Printer Proprietor Apex Products Private Limited is still pending, therefore, this matter may be heard after disposal of the writ petition being W.P.(C) No.151 of 2015.
This Court, after considering the aforesaid submission, is of the view that since the writ petition being W.P.(C) No.151 of 2015 is pending for its adjudication in another co-ordinate Bench, it would be appropriate and proper for this Court to wait for the outcome of the said writ petition.
Accordingly, list this case immediately after disposal of W.P.(C) No.151 of 2015.
Parties are at liberty to make motion for early hearing after disposal of W.P.(C) No.151 of 2015.
